Letter to the Editor: Bannister Thanks Supporters

Recent Kendall County Recorder candidate Jerry Bannister reacts to the referendum eliminating that office.

I would like to thank everyone who supported my efforts to split the Clerk & Recorder's offices.  I am disappointed that the referendum vote did not go my way, but I am happy that my campaign caused positive changes to be made in the Recorder's office.  The Clerk & Recorder's website that put thousands of people at risk for identity theft has been taken down and private military discharges have been removed from the public areas of the Recorder's office.  The people of Kendall County are better protected and that is a victory in itself. March 2012 Primary: Kendall County Referenda Results

What did voters say about the telephone surcharge increase and eliminating the auditor's and recorder's offices?

Without further ado, here's what Kendall County voters had to say about these three questions. Shall the elected Office of Kendall County Auditor be eliminated effective Dec. 1, 2012? (A "yes" vote means the office goes.)   Shall the Office of Recorder of Kendall County be eliminated effective Dec. 1, 2012, and the functions and duties of that office contine to be performed by the Kendall County Clerk? Letter to the Editor: Recorder/Auditor Refenda Problem?

This letter-writer ponders how voters could consider eliminating offices that candidates are seeking.

In 1972, Cook County government ran into the same situation. The elimination of the Coroner's Office was placed on a referendum during the same election cycle as the Coroner was seeking office.  The 1970 Illinois Constitution is clear that a County Officer, such as the Recorder, Auditor, or Coroner is to be elected to a 4 year term.  Also, the Constitution stated that said offices can be eliminated by referendum.  What is not clear is that once the election cycle has begun, can the office be eliminated, as of the next swearing in of the Officer.  To alleviate the situation in 1972, the candidates for Coroner signed off that whoever wins the election would serve the full term, and the office would die in 1976.  This is what happened.  Given…

I asked Kendall County State's Attorney about the concerns in this letter, and this was his response: "While I cannot provide legal advice, we did research the issue and presented the Board with the two referendum (Recorder and Auditor) for a vote. Mr. Youhanaie brings up an interesting topic for discussion. I guess we will wait and see what happens after March 20."   more ›
