Toftoy, Milliron Discuss Maternity Leave Pay

Frequent Kendall County critic Todd Milliron questions whether Coroner Ken Toftoy appropriately handled his sole full-time employee's leaves.

Kendall County Coroner Ken Toftoy responded Tuesday to concerns surrounding the maternity leaves for his only full-time employee, who also is the County Board chairman’s wife.

Frequent County Board critic and watchdog Todd Milliron had questioned how Jacquie Purcell received what appears to be her normal pay throughout maternity leaves in 2010 and 2011 while Toftoy hired part-time workers to cover office administrative duties.

Both times, the short-term opening was not advertised, Toftoy said. He hired a friend Purcell suggested in 2010. In 2011, Toftoy hired a fellow active Republican Matthew Prochaska, who is running for County Board. Prochaska is secretary of the Kendall County Republican Central Committee, while Toftoy is the chairman, according to the party's website.

Toftoy also said Kendall County State’s Attorney Eric Weis assured him he had acted appropriately when the issue surfaced this spring.

In recent weeks, Milliron has questioned how Purcell could have banked enough sick and vacation time since she was hired in September 2004 to cover her apparent maternity leaves. The county’s employee handbook states each county employee receives 12 sick days a year and can allow up to 240 sick days to accumulate, according to the handbook Milliron provided. Employees who have worked for the county for seven to 14 years received 15 vacation days a year and can carry over no more than 22.5 vacation days each month, according to the handbook Milliron provided.

But Toftoy said he never required his lone full-time employee to request vacation using a standardized form. Rather, Purcell just tells him informally when she’ll be gone.

“I just write it down on the calendar: Jacquie’s taking this week,’” Toftoy said.

She rarely, if ever, uses sick days, Toftoy said. His office is flexible enough that if she is feeling under the weather, she can handle administrative work in the office and allow other deputy coroners to work in the field, Toftoy said.

Her son was born in July 2010, with her replacement receiving $3,345 in paychecks from April 29, 2010 to Nov. 16, 2010, according to information Milliron received through a Freedom of Information Act request. Purcell was not on-call for field investigations from July 7, 2010 to Nov. 8, 2010, according to Milliron.

More recently, Purcell’s daughter was born in August 2011, and Purcell was not on-call for field investigations between July 7, 2011 and Oct. 21, 2011, Milliron said. Prochaska earned $3,145 as a part-time administrative assistant between June 2011 and October 2011, according to documentation Milliron provided.

During both periods, Purcell never requested a formal maternity leave or unpaid time off through the Family and Medical Leave Act, Toftoy said. Rather, she just used all her sick and vacation time and then returned to work.

“I’ve tried to explain that to Todd (Milliron),” Toftoy said. “I’ve tried to explain that to other people.”

The 1960's good old boys club is alive and well in kendall county. Looks like mr. Million and the patch are the only ones not letting it slip by unnoticed. So sad that mr. Toftoy doesn't understand why this lack of procedure transparency is wrong. How much of our tax dollars does he make/take every year?

It seems to me that Mr. Milliron is doing the work that we Republicans find virtuous. Fiscal discipline, accountability, transparency, and equal treatment are espoused as vitrues with the National Republican Party. Should there be a difference, locally?Mr. Milliron is holding the Republican led county's feet to the fire. Unfortunately, this is because the county has been shown to have a severe case of anti-Republicanism.

I'm a math guy and most of my friends probably think of me as a "right wingnut" republican, but if we just look at the first leave, it was about 120 business days. Mrs. Purcell would have only been entitled to about 75 sick/vacation days at that point. I've been losing faith in the Kendall County Republican Party Leadership. Many of the leaders do not exhibit the ideals that the party espouses. Kendall County is better off because of a guy like Todd Milliron and I really could care less which party he is affiliated with. Wrong is wrong.

Todd is quickly becoming a joke. He seems to think his inability to understand rules, means that someone else broke them. Now that he knows his other 'investigation' is fruitless, he will carry on with another time-wasting and money wasting wild goose chase to send the local government on. Todd should start to put up his own money to pay for all these frivolous 'investigations' when they inevitably turn up nothing.

No, Tim. What's a joke is when county officials forget who is paying the bills, expenses, salaries and perquisites. Maybe you think the rules allow for a county board member to "pad his income" by attending more committee meetings (even when that person is not a formal member of that committee). Maybe you even believe that the rules allow for county employees to take six months maternity leave with 100% pay even though the employee has not accumulated enough sick leave or vacation time to cover it. I for one appreciate the fact that Mr. Milliron is bringing these subjects to our attention. Because if the rules are shown to ultimately allow these behaviors (still being investigated and open to debate), the rules need to be changed and the people who feel that its okay to exploit the rules at the taxpayers' expense need to be voted out of office.

This county needs more people like Todd. He may be called a watchdog but I bet this Board thinks he's a poodle on their ankle. One that won't let go and for that I am thankful we have him. It's been his time, effort, research, meeting attendance, and educating himself on all the documents he shares with you. He does the leg work and research and provides you the documentation. You read it and decide whats going on. There should be a lot more of us doing this. Why, because it's the only thing that will change the way things are being done today. Our Crook County corporate tax system is intentionally corrupt. The Democrat State Chairman, who is also the Speaker of the Illinois House (Speaker Mike Madigan), and the most senior alderman in Chicago, each make well over a million dollars a year putting the fix in for their clients tax assessments. Cook County's property tax system is a disaster: The assessed value of our Chicago home was 50% higher than the sale price. Our home value is down 40%, our property taxes are up 20%, and our local schools have still another referendum on the ballot to increase taxes more than 20% next year. The Illinois system is unfair and incompetent. In the Hill Country of Texas (near Austin and San Antonio) we bought a gracious home on almost 2 acres with a swimming pool. It is new, will cost us around 40% of what our home in Wilmette just sold for, and the property taxes are a third of what they are here.

We are moving to Texas where there is no income tax, while Illinois just went up 67%. Texas sales tax is half of ours, which is the highest in the nation. Southern states are supportive of job producers, taxpayers and folks who offer opportunities to their residents. Illinois shakes them down for every penny that can be extorted from them. I could go on, but enough is enough. I feel as if we are standing on the deck of the Titanic and I can see the icebergs right in front of us. I will miss our friends a great deal. I have called Illinois home for essentially my entire life. But it is time to go where there is honest, competent, and cost effective government. We have chosen to vote with our feet and our wallets. Part 2 of 2 = I don’t play favorites; I document what I find and call them like I see them and make no bones about it. I do not distinguish between wrong doers or perceived levels of wrong doing, wrong is wrong and the offender whether it be the Kendall County Board Chairman, the County Coroner, a greedy Kendall County Board Member or the Chairman of the Kendall County Republican Party all need to be called to task for their unethical and illegal actions. Actions speak louder than words and as you did notice I am trying to do something about it. I would have much rather spent my Father’s Day with my family, but there is a job to do and someone has to do the job of cleaning up this county’s government. We can either do it at the ballot box or that job can be done in a court of law. You should have some new material regarding other board member’s acts of illegal behavior to discuss and talk about real soon, yet still others who we entrusted our tax money to and they too chose to ignore the law and commit yet new crimes to benefit a select few insiders.

Minooka Mom, You call Todd a liar but you have no problem with the abuses called out and documented for all to see. Are you not looking at these documents, are you friends with some of the crooks on this board. Please provide some facts based on your direct allegation of liar. I haven't seen one piece of evidence other than opinion and that holds squat. A thief is a thief. Spend sometime looking at the facts and evidence vs calling someone a liar when you have Zip to back it up.
