Plano Man Sentenced for Drug-Induced Homicide

Kevin M. Mueller, 25, told police he introduced his girlfriend to heroin so he wouldn't have to use alone.

The Plano man who told police he dozed as his 17-year-old girlfriend fatally overdosed on heroin was sentenced last week to 12 years in prison for drug-induced homicide, court records show.

Kevin M. Mueller, 25, of the 600 block of West Abe Street, told police in May 2011 that he and his girlfriend of 6 months had driven to Chicago and acquired heroin, court records show. They went to his home, where he divided the heroin in two lines and the pair inhaled it. When he awoke, she was dead, court records indicate he told police.

Mueller also told police he introduced the girl to heroin because he didn’t want to abuse it alone, Kendall County State’s Attorney Eric Weis said in a news release. Drug-induced homicide, a Class X felony, targets those who sell, hand or otherwise transfer controlled substances to someone who later dies after ingesting any amount of that substance.

“This young girl would still be alive if Kevin Mueller had cared enough about his girlfriend,” Weis said in a news release. “Mueller introduced her to heroin as a way to make himself feel better about his own use.  His drug use ultimately led to him going out and buying this lethal drug for both of them to use.  This is just another example of how dangerous and deadly heroin use can be.”

Mueller will have to serve at least 75 percent of the 12 years before being eligible for parole, and will receive credit for the 395 days he spent behind bars while the case was pending. Once released, he will be on parole for 3 years.

In court records, the 17-year-old’s family describes her as a family-oriented girl who received her GED early and had 9 months of perfect attendance and a 4.0 GPA in a medical assistant program at Everest College. They said she was distraught about her relationship with Mueller but didn’t know how to break it off, court records show.

She died 10 days before her 18th birthday.
