No Bond Reduction in Underaged Sex Case

Patrick Loza, 22, of Aurora, has been charged with predatory criminal sexual assault for multiple alleged sex acts with a preteen girl.

A Kendall County judge declined to reduce the $250,000 bail for a 22-year-old Aurora man accused of sexually assaulting a 12-year-old Yorkville area girl.

Patrick Loza, of the 400 block of Grand Avenue, faces four counts of predatory criminal sexual assault and five counts of aggravated criminal sexual abuse.

Prosecutors are alleging Loza participated in multiple sex acts with the girl between June 1 and July 5, court records show. He was arrested July 5 after Yorkville police found him in a parked SUV with the girl, who willingly went with him, police said.

On Thursday morning, defense attorneys asked Judge John Barsanti to reduce the bail to $10,000, which would require posting $1,000 for release while the case is pending.

Defense attorneys argued that Loza, a life-long Aurora resident, was not a flight risk. He offered to participate in electronic monitoring, stay off the Internet and social networking sites and to leave his home only for court and for work. He had a job waiting for him at his father’s workplace, defense attorneys said.

His only prior criminal case involved a charge of possession of drug paraphernalia in Kane County; he received court supervision in that case, according to the defense motion.

Prosecutors argued against the bail reduction, pointing to the severity of the charges Loza faces. Prosecutors said he faces consecutive prison sentences if convicted of multiple counts of predatory criminal sexual assault. If convicted of that charge, probation would not be an option.

Barsanti maintained the $250,000 bail after reading a synopsis of the case prosecutors provided in court. Loza’s family cannot raise the $25,000.

The case is next due in court Aug. 4 for an arraignment or preliminary hearing.
