Delaney Resigns from Yorkville Police Dept.

The former deputy chief, accused of stealing prescription drugs, had been facing a disciplinary hearing that could have led to his termination.

The former Yorkville deputy police chief accused of stealing prescription painkillers from a department program he oversaw resigned Monday, Police Chief Richard Hart said Tuesday afternoon.

David Delaney has been charged with unlawful possession of a controlled substance and theft of government property, both Class 4 felonies.

He allegedly took hydrocodone pills in May from a program meant to safely dispose of residents’ unwanted and unused prescription medication. His arrest came after a week-long Illinois State Police investigation that did not implicate any other police officers.

Monday's resignation came on the same day as a scheduled disciplinary hearing before the city's police commissioners. The hearing, which is separate from criminal procedings, could have resulted in his termination but was canceled in light of his resignation.

Hart said he could not release more details due to the pending criminal case. Delaney did not return to work at the police department after his arrest and has been stripped of his title. Delaney has been on since June 20.

Delaney is next due in Kendall County Court Jan. 12.

Kendall County State's Attorney Eric Weis originally was handling the case but because Weis' long-standing personal and professional relationship with Delaney.

If convicted of a Class 4 felony, Delaney could no longer work as a police officer in Illinois and would face probation or up to three years in prison.
